Privacy Policy - Driver

This Privacy Policy describes how LYMO SA, having its corporate seat at 17 rue de la Croix-d'Or, 1204 Geneva, and its affiliates (hereinafter "LYMO" or "we") collect, use and process your personal data, for what purpose this personal data is collected and the rights you have under the applicable data protection laws and regulations.

LYMO is the controller of the data file in charge of processing your personal data and can be contacted through an e-mail to hello@lymo.com or by post to the aforementioned address.

This Privacy Policy applies to all LYMO websites, applications, services, contracts and tools that do not contain any specific data protection provisions.

Any material changes made to our Privacy Policy will be notified to you on the LYMO application or by email or SMS. Subject to the applicable law, you consent to our policy updates if you use our services after such updates or modifications have been notified.

1) Personal data collected

The personal data that we collect is:

Driver account data

We collect the information that you provide when you create or modify your LYMO account. This information may include your name, name of your company, address, copy of your identity papers, copy of your driver license, photograph of you and your car, e-mail, telephone number, social security number, registration number as independent, copy of your professional driver authorization/card, license plate registration and chassis numbers, excerpt from your criminal record, details of your car insurance, professional liability insurance, car registration card (“carte grise”), details of your credit card, banking details and your preferences and settings in your account.

Geo-location data

LYMO's purpose is to connect riders and transportation service providers /drivers. The driver’s geo-location data is collected when the LYMO application is activated but also in the background even when the application is closed. This is essential to ensure ride requests are shared with the driver based on his geolocation even when he is not actively using the app. The geo-location data collection stops when the application is uninstalled/deleted.

Device information

LYMO may collect data about the devices you use to access our services, including device model, IP address, operating systems and versions, software, file names and versions, language preferences, advertising identifiers, serial numbers and mobile network data.

Transaction data

We collect information about transactions related to your use of our services, including the orders received, the date and time of the services, the amount invoiced, the distance travelled, the itinerary and the payment method.

Communication data

We allow riders and drivers to communicate with each other and with LYMO via chats, telephone or text messages. To provide this service, LYMO receives information relating to calls or text messages, including the date and time of the interaction and the content of the communications. LYMO may also use this information for support services, security issues, analysis, and improvement of its products and services.

Ratings

We collect information when riders and drivers provide ratings on each other after a ride.

Cookies and similar identification technology

Cookies are small text files that are stored in your browser or on your device by websites, applications, online media and advertisements. They recognize the device of a user. LYMO uses cookies and similar technologies, in particular for (i) user authentication, (ii) registration of user preferences and settings, (iii) generating statistics, (iv) evaluating publicity campaign performances and (v) analyzing traffic and trends, and more generally understanding the browsing behaviors and interests of the users of our services. You can deactivate the use of cookies by selecting the appropriate settings on your browser. This may however prevent the use of certain features of LYMO services.

2) Purpose of the data collection

We collect your personal data for the following purposes:

The conclusion and execution of the contract/your use of the application:

We collect and process your personal data to create and update your driver account and generally to allow your use of the LYMO platform by connecting you to riders.

We obtain your banking/payment card information to pay the amounts received on your behalf for the rides and to debit the amounts due for the use of the application.

We use your personal data to communicate with you in connection with your use of the LYMO application/platform, assist you and respond to your requests but also to inform you about new features and updates of the application or other LYMO services.

We collect data on the itineraries taken by drivers and passengers to analyze the geographical coverage and provide recommendations to drivers on the fastest itineraries.

Holding a register

Some legislations provide that a ride dispatcher must hold and store a register containing the following information:

  1. the names and surnames of the drivers with whom the ride dispatcher collaborates directly, their date of birth, their social security number, the dates of the beginning and the end of the collaboration;
  2. the name of the companies with which the ride dispatcher collaborates, the dates of the beginning and the end of the contract;
  3. the license plate registration and chassis numbers of the cars used by the drivers and the transport companies.

The protection of legitimate interests

Personal data may also be processed to protect legitimate interest of LYMO and of third parties, for security reasons or for example to investigate fraudulent payments and detect them or for the exercise of legal rights and defenses in litigation.

LYMO marketing communications

We use your e-mail and phone number to inform you of new products or send promotional offers. We may customize our communications depending on how you use LYMO (frequency, trips, payment method etc.). If you no longer wish to receive our communications, you can click on the "Unsubscribe" link at the end of our communications or under "Settings" in the LYMO application.

3) Transmission of personal data

Your personal data may be transmitted to the following persons or entities:

Riders/clients

Data on drivers is disclosed to the rider having ordered a ride through the LYMO application. In such case, the rider will see your name, your photograph, your car, your license plate registration number and your geo-location data. The rider can also contact the driver by phone, chat or SMS but without having access to his telephone number which remains anonymous.

Third party service providers

We do not share your personal data with any unauthorized third party. Our employees only have access to the data they need to fulfill contractual and legal obligations. LYMO may hire service providers or agents to provide services on behalf of LYMO, including the management of the websites, the application and the services provided to you. These third parties may have access to your personal data and process it when providing these services. LYMO requires these third parties (who may reside outside the country from which you accessed the website or the service) to comply with all applicable data protection laws and security requirements relating to your personal data. LYMO does not transmit your personal data to third parties who intend to use it for direct marketing purposes unless you explicitly authorize it.

Group companies

In order to operate the LYMO services or functionalities, personal data may be disclosed to LYMO group companies and partners. The processing of personal data by the companies and partners of the LYMO group will be done under the same conditions as those set out in this privacy statement.

4) Rights of the persons concerned

You can access and update the personal data of your driver account at any time via the LYMO application.

You can also at any time:

  • ask us to update or correct the data we hold relating to you;
  • withdraw your consent for the processing of your data for a specific purpose;
  • ask us to delete or erase your data from our systems;
  • limit or oppose the processing of your data;
  • ask us to provide a copy of the personal data we hold relating to you in an easy to read electronic format or to transfer this data directly to a third party designated by you.

To exercise the above rights, and for any other questions or comments regarding this Privacy Policy, please contact us by e-mail at hello@lymo.com or by post addressed to LYMO enclosing proof of your identity along with your request.

Please note that we may be required to keep some of your personal data as part of our legal and contractual obligations even after you have requested its deletion. In addition, the deletion of your personal data may have the effect of preventing you from continuing to use the services.

Finally, if applicable, you have the right to lodge a complaint with a regulatory authority competent for data protection issues.

5) Security

LYMO takes the appropriate technical and organizational measures to protect your personal data and we only store such data on secure servers. The application and the site are protected by state-of-the-art technology against loss, destruction, manipulation of data, access to it and modification or disclosure by unauthorized persons.

In principle, the data communicated via the Internet platforms made available by LYMO are transmitted in encrypted form.

When you send us information via the Internet or other electronic communication media, there is always a risk that it may be lost, damaged or manipulated. This is done at your own risk.

If we become aware of a security breach, we will notify the affected users so that they can take appropriate action.

6) Storing your data

We process and store your personal data for the duration required by the applicable legal and contractual provisions.

Your personal data will be stored as long as you have an active driver account. If you close your account, the personal data will be removed from our database unless this data is to be kept for legal or accounting purposes, dispute resolution or fraud prevention.

Please note that deleting the LYMO application from your device does not automatically delete your personal data.
